Terms of Service — Bharat Picks

Welcome to Bharat Picks. These Terms of Service ("Terms") govern your use of our online store (the "Site") and your purchase of products from BharatPicks Private Limited ("Bharat Picks", "we", "us"), a company incorporated in India with its office in Sundargarh, Odisha. By using the Site or placing an order, you agree to these Terms. Please also read our Shipping Policy, Refund & Return Policy, and Privacy Policy, which form part of these Terms.

1. Who we are

Bharat Picks is the seller of record for products listed on this Site. We curate authentic Indian handloom and handicraft products — including Sambalpuri ikat from Western Odisha — sourced from weavers, artisan clusters, and verified suppliers.

2. Eligibility

You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872 to purchase from the Site. If you are under 18, you may use the Site only with the involvement of a parent or guardian.

3. Products, authenticity & descriptions

  • Our handloom products are handwoven and hand-dyed. Small irregularities in weave, motif, and colour are inherent to the craft and are not defects.
  • Colours in photographs may vary slightly from the actual product due to screens, lighting, and dye lots.
  • Where a product is described with a Geographical Indication (GI) name (e.g., "Sambalpuri Bandha Saree"), we source such products from the relevant region/craft cluster in good faith. Product-specific details (fabric, dimensions, care) are stated on each product page.
  • We reserve the right to correct errors in descriptions or pricing and to limit quantities per order.

4. Pricing & payment

  • All prices are in Indian Rupees (₹, INR) and, unless stated otherwise, inclusive of applicable GST. Shipping/COD charges, if any, are shown at checkout before you pay.
  • We accept UPI, cards, net banking, wallets (via our payment gateway) and Cash on Delivery on eligible PIN codes.
  • In case of an obvious pricing error, we may cancel the order and refund any amount paid in full.

5. Orders & acceptance

Your order is an offer to buy. We accept it when we dispatch the products. We may refuse or cancel orders in cases of suspected fraud, unserviceable PIN codes, stock unavailability, or pricing errors — with a full refund of any amount paid.

6. Shipping, returns & cancellations

Handled as per our Shipping Policy and Refund & Return Policy. In short: 7-day return window for damaged, defective, or wrong items; unboxing video/photos required for transit-damage claims; COD refunds via UPI/bank transfer.

GPS & CCTV service orders: Products listed under Business Solutions (AIS-140 GPS packages, annual renewals, CCTV site surveys, kits and AMC) are service orders fulfilled by scheduled technician visits or remote activation within our Odisha service areas. GPS orders are prepaid only (no COD). A service order cancelled before the scheduled visit or activation is refunded in full; a GPS subscription or renewal already activated on the portal is non-refundable for the activated period.

7. Your account & conduct

You are responsible for the accuracy of the information you provide (address, phone) and for keeping your account credentials secure. You agree not to misuse the Site — including posting unlawful content in reviews, attempting to breach security, scraping content, or placing fraudulent orders (including repeated COD refusals).

8. Intellectual property

All content on the Site — the Bharat Picks name and logo, product photographs, descriptions, weaver stories, and course/videos — is owned by or licensed to BharatPicks Private Limited and protected under Indian copyright and trademark law. You may not reproduce it commercially without our written permission. Craft traditions belong to their communities; our original expressions of them (photos, text) belong to us.

9. Reviews & user content

By posting reviews or photos, you grant us a non-exclusive, royalty-free licence to display them on the Site and our social channels, with credit where practical. We may remove content that is unlawful, abusive, or fake.

10. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising out of an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses. Nothing in these Terms limits rights that cannot be excluded under the Consumer Protection Act, 2019.

11. Force majeure

We are not responsible for delays or failures caused by events beyond our reasonable control — natural calamities, strikes, transport disruptions, government restrictions, or courier network failures.

12. Governing law & disputes

These Terms are governed by the laws of India. Subject to the consumer-forum rights available to you under the Consumer Protection Act, 2019, courts at Sundargarh, Odisha shall have exclusive jurisdiction.

13. Grievance Officer & consumer complaints

Grievance Officer: Razat (Director), BharatPicks Private Limited, Sundargarh, Odisha, India — care@bharatpicks.com (subject: "Grievance"). We acknowledge complaints within 48 hours and aim to resolve within 30 days, in line with the Consumer Protection (E-Commerce) Rules, 2020. You may also use the National Consumer Helpline (1915 / consumerhelpline.gov.in).

14. Changes to these Terms

We may update these Terms from time to time. The version published on the Site at the time of your order applies to that order.
